I offer you my more than 20 years of experience as a lawyer for several real estate banks: What are the typical “traps” in real estate purchase contracts, such as warranties, covenants, contaminated sites?  I cover private as well as public construction law, check contracts with builders, developers and craftsmen and support you in applying for building permits and removing obstacles. I check the financing and collateralization of mortgage loans for you. In the case of existing loan agreements and loan collateral, I support you, for example, in the question of whether the credit institution may charge an early repayment penalty and, if so, in what amount or whether the bank may, under certain conditions, demand repayment, an increase in the interest on the loan or further loan collateral.

Or you are in a liquidity shortage and the bank also demands the repayment of your loan?

Thanks to my many years of experience as a bank lawyer at various commercial and real estate banks in Germany and abroad, I can provide you with a broad range of knowledge. I also know from experience how credit institutions think and what measures they take and when.

What needs to be considered when taking out financing? Which financial covenants, reporting obligations, termination rights of the lender are critical and should be changed? Special focus should be placed on the provision of loan collateral and clauses on submission to immediate foreclosure. When is the bank obligated to return loan collateral?

In the case of early repayment of financing: Is the credit institution entitled to demand prepayment penalties? In what amount? Has the loan agreement been validly concluded at all or are there formal or advisory errors?

If you find yourself in a liquidity shortage: Is the bank just now entitled to demand additional loan collateral from you? Is it allowed to increase the interest rate on the loan or to threaten you with termination of the financing? Is the lender entitled to demand further information from you about your income and financial circumstances? I will be happy to provide you with information.
